Not really but you could find a oneway bearing that went bad and have no braking at all I guess.

It is very easy to defeat the engine brake-- give it a little gas.

yes, but when you let off it's through the winshield. I guess don't let off

Now I think it is a matter of getting used to-- most people love the engine braking ability of the Rhino but if you aren't used to it could be distracting. I have also heard of people complaining their quad/SxS doesn't have engine braking.
